Jurisdictional immunities of the State (Germany v. Italy: Greece intervening) (International Court of Justice, 03-02-2012)
Casus
Deze zaak ging over de reikwijdte van staatsimmuniteit. Diverse Italiaanse hoven hadden de immuniteit van Duitsland genegeerd als het ging om claims van slachtoffers van het Nazi regime.
The International Court
Deze kwam tot de conclusie dat de Italiaanse staat onjuist was door de immuniteit van Duitsland te negeren. Italië diende dan ook de beslissingen van zijn hoven in deze kwesties zonder effect te achten. Door Italië aangedragen uitzonderingen op deze staatsimmuniteit werden door the international court onjuist geacht. Uiteindelijk is het doel van die immuniteit namelijk om een eventueel rechtsproces te voorkomen.
Jus Cogens en staatsimmuniteit zijn niet met elkander in conflict.
