De werknemer in deze zaak heeft al jarenlang als verkoper op een vaste tijd gewerkt. Zijn werkgever exploiteert winkels op Schiphol die 7 dagen per week van ongeveer 3.30 uur tot 23.00 uur open zijn. De werkgever wil de werktijden echter wijzigen voor al zijn werknemers.
De werknemer is Joods en besloot opeens om religieuze invulling te geven aan het Jodendom en wilde daarom op zaterdag niet meer werken. Als gevolg van zijn keuze dient hij de sabbatsrust in acht te nemen. Zijn werkgever heeft toen voorgesteld om hem zoveel mogelijk zo in te roosteren dat hij op zaterdagochtend de synagoge zou kunnen bezoeken. Er was geen mogelijkheid om de werknemer elke zaterdag vrij te geven. De werknemer stemde hier niet mee in en de werkgever ontsloeg hem op staande voet.
Kantonrechter
De kantonrechter bevestigde dat het wettelijk individuele instemmingsrecht niet absoluut geldt.
De werkgever mocht zich op het standpunt stellen dat de wens van de werknemer onverenigbaar was met het roosterbeleid. Immers, de eis van de werknemer zorgde ervoor dat de werkgever de wisseldiensten niet evenredig kon verdelen onder de werknemers. Echter, gezien de bijzondere en serieus te nemen beweegreden die de werknemer aanvoerde, was ontslag op staande voet een te vergaande sanctie. De werkgever kon volgens de rechter de arbeidsovereenkomst ontbinden zonder vergoeding.
Er dient dus een belangenafweging van werknemer en werkgever plaats te vinden. I.c. gaan de belangen van werkgever voor. De werkgever moet al het mogelijke doen om de werknemer tegemoet te komen, maar hij hoeft hiervoor geen apart roosterbeleid te voeren voor één werknemer.
