Had de burgemeester de woning mogen sluiten?

In dit arrest kiest de ABRvS voor een nieuwe benadering van het begrip 'bijzondere omstandigheden'. Bijzondere omstandigheden zijn nu ook onder omstandigheden die bij het opstellen van een beleidsregel zijn verdisconteerd en daarom kunnen leiden tot een afwijking van de beleidsregel. In de praktijk blijkt dat het betrokken bestuursorgaan niet heeft kunnen voorzien of enkel deze omstandigheden of alle omstandigheden samen in het concrete geval tot onevenredige gevolgen heeft kunnen leiden. Daarom moet het bestuursorgaan alle omstandigheden van het concrete geval bij het oordeel betrekken en beoordelen of deze (samen of apart) als bijzondere omstandigheden moeten worden aangemerkt in de zin van art. 4:84 Awb. Vervolgens kan het bestuursorgaan beoordelen of deze bijzondere omstandigheden ertoe leiden dat het handelen overeenkomstig de beleidsregel onevenredige gevolgen met zich mee brengt.
