HR 19 december 2006, NJ 2007, 29, 'Vrijwillige terugtred bij voltooide poging'.
Rechtsvraag
Kan er sprake zijn van vrijwillige terugtred wanneer reeds sprake is van een voltooide poging?
Casus
Verdachte sprong met zijn zoontje van 5 maanden in het Eemskanaal en klom daarna met de baby weer uit het water. Hij verklaarde:"We gingen wel kopje onder, maar het was ondiep en ik kon gewoon staan. Door de kou kwam ik weer goed bij en wist ik dat ik niet goed bezig was. Ik wilde hem naar het ziekenhuis brengen omdat hij nat en koud was en ben daarom richting Groningen gereden". Kort daarna werd de verdachte aangehouden door de politie die in de auto de natte en koude baby in een deken gewikkeld aantrof. Verdachte is vervolgd ter zake van poging tot moord.
De Hoge Raad
De Hoge Raad verwierp de door het OM geponeerde stelling dat in dit geval van een voltooide poging tot moord, waartoe door de dader reeds toereikende middelen waren aangewend alvorens hij tot inkeer kwam, vrijwillig terugtreden niet meer mogelijk was. De Hoge Raad oordeelde echter dat van buiten komende, van verdachtes wil onafhankelijke factoren die mede tot de niet voltooiing van het misdrijf hebben geleid (in casu de ondiepte van het kanaal en de kou) niet in de weg hoeven te staan aan vrijwillige terugtred. Het oordeel van het Hof in deze zaak dat de oorzaak van het niet voltooien van het misdrijf was gelegen in de van verdachtes wil afhankelijke omstandigheden dat hij uit het kanaal is geklommen en met zijn kind naar het ziekenhuis is gereden was in de ogen van de Hoge Raad niet onbegrijpelijk.
