Casus
Een Rooms-Katholieke school in Volendam kwam met een besluit om hoofddoeken op de school te verbieden, die door Islamitische personen werden gedragen. Een Islamitisch meisje voelde zich in haar rechten geschonden en diende een klacht in bij de Commissie Gelijke Behandeling, die vervolgens een beroep aanhangig maakte op grond van een beperking op de vrijheid van godsdienst.
Gerechtshof Amsterdam
Het Gerechtshof Amsterdam heeft geoordeeld dat het hoofddoekverbod van het Rooms-Katholieke Don Bosco College in Volendam niet onrechtmatig is jegens een leerlinge die een hoofddoek wil dragen als uiting van haar Islamitische geloof. Het Gerechtshof overwoog hiertoe: “Voor zover het gaat om een instelling van bijzonder onderwijs met een godsdienstige of levensbeschouwelijke grondslag, past de rechter grote terughoudendheid, zowel bij de beoordeling of bepaalde eisen nodig zijn voor de verwezenlijking van die grondslag, als bij de uitleg van dergelijke eisen van godsdienstige of levensbeschouwelijke aard, alsmede bij de beoordeling of in een concreet geval is voldaan aan dergelijke eisen. Deze beoordelingen en deze uitleg komen in beginsel – behoudens bijzondere omstandigheden – toe aan de instelling zelf. De rechter heeft daar dus slechts een beperkte taak.”
Ook overwoog het Gerechtshof dat de leerlinge en haar vader bekend waren met de katholieke grondslag van de school toen de leerlinge bij de school werd ingeschreven. Zij moesten er dan rekening mee houden dat een zichtbare uiting van het islamitische geloof mogelijk niet zou zijn toegestaan.
