Wat is belangrijk voor het tentamen?

Belangrijk voor het tentamen is een verschil te maken tussen Zaakwaarneming en bewaarneming (7:600 BW). Bij bewaarneming bestaat er een verplichting vanuit een overeenkomst. Dan is er dus geen sprake van zaakwaarneming. Zaakwaarneming bestaat uit een spontane actie.

Er zijn voor zaakwaarneming verschillende vereisten te noemen die volgen uit artikel 6:198 BW. Er moet sprake zijn van;

Ongerechtvaardigde verrijking strekt wel tot schadevergoeding. Er moet sprake zijn van de vereisten uit artikel 6:212 lid 1 BW, deze vereisten dien je voor het tentamen te kennen.
