Casus

Het echtpaar Goosen-Dekkers heeft zich bij notariële akte in 1980 als hoofdelijk schuldenaar verbonden aan een lening verstrekt door Jan Goosen aan de BV Wodania. Wodania ging eind 1981 failliet en betaalde niets van deze lening terug. Jan Goosen heeft daarop de notariële akte aan het echtpaar laten betekenen en beslag gelegd. Het echtpaar heeft zich verzet in een tweetal gedingen, waarbij dit verzet ongegrond is verklaard. Beide vonnissen van de rechtbank Breda zijn door het Hof bekrachtigd. Na deze bekrachtiging in 1987 ontdekt het echtpaar dat de NMB - de bank bij welke Jan Goosen het door hem aan Wodania geleende geld op zijn beurt had geleend- in 1986 een deel van de schuld had kwijtgescholden. Hiervan heeft Jan Goosen nooit melding gemaakt in de gedingen. Het echtpaar vordert herroeping van de arresten van het Hof op grond van bedrog ex. art. 382 onder 1 Rv.

 

Rechtsvraag

Is bedrog een grond om het vonnis te herzien?

 

Hoge Raad

Het in art. 382 onder 1 Rv voorkomende woord "bedrog" moet tezamen met de woorden "of arglist" worden opgevat als de weergave van één , hierna als "bedrog" aan te duiden maatstaf. Van bedrog in deze zin is reeds sprake wanneer een partij door haar oneerlijke proceshouding belet dat in de procedure feiten aan het licht komen die tot een voor de tegenpartij gunstige afloop van die procedure zouden kunnen hebben leiden. Dit zal zich onder meer voordoen wanneer een partij feiten als hiervoor bedoeld verzwijgt, terwijl zij wist of behoorde te weten dat de tegenpartij niet met die feiten bekend was of redelijkerwijze behoorde te zijn. Art. 3:44 lid 3 BW is hier niet van toepassing en de uitleg daarvan is niet bepalend voor die van art. 382 onder 1 Rv.
