Zijn partijen (twee particulieren), die in de loop van een geding hebben afgesproken om te pogen een minnelijke regeling langs de weg van mediation te bereiken, gebonden aan deze mediation-afspraak?
Hoge Raad
Gelet op de aard van het middel van mediation staat het beide partijen te allen tijde vrij hun medewerking daaraan alsnog te onthouden, dan wel die om hen moverende redenen te beëindigen.
