Casus
In deze zaak ging het om een wettelijke verdeling van de erfenis tussen de echtgenote en haar twee kinderen; een zoon en een dochter. De erflater had bepaald dat de vrouw na verkoop van de woning elk een derde van de koopprijs moest uitbetalen. De vrouw verzoekt aan de kinderen of zij ermee akkoord willen gaan dat op hun vorderingen een verzorgingsvruchtgebruik gevestigd kan worden. De dochter gaat hiermee akkoord, de zoon niet. De kantonrechter en het hof delen de mening dat met het verzorgingsvruchtgebruik op de vordering van de dochter al voldoende verzorging wordt geboden, zodat het verzorgingsvruchtgebruik op het aandeel van de zoon niet meer van toepassing is.
Hoge Raad
De Hoge Raad gaat hier in mee. Deze uitkomst is onbevredigend, omdat de kinderen op deze wijze zeer ongelijk worden behandeld. De dochter moet immers afwachten hoe lang haar moeder nog leeft voordat zij het bedrag ontvangt, terwijl de zoon gelijk het bedrag toebedeeld krijgt.
