Casus
In dit arrest komt de afbakening tussen woonruimte en bedrijfsruimte aan de orde. Fuks huurde een woning aan de Churchillaan te Amsterdam van Recourt en begon een tandartspraktijk in de woning die hij gehuurd had onder het regime woonruimte. Toen Recourt daarachter kwam eiste hij een hogere huur, omdat Fuks zijn woning was gaan gebruiken als bedrijfsruimte.
Hoge Raad
De vraag in deze zaak is of de Huurprijzenwet Woonruimte van toepassing is ingeval een onroerende zaak is verhuurd bij één huurovereenkomst, krachtens welke overeenkomst deel van het gehuurde door de huurder wordt gebruikt als woning en een ander deel als ruimte voor het uitoefenen van zijn tandheelkundige praktijk. Het gehuurde wordt niet geheel als woonruimte aangemerkt indien, mede in aanmerking genomen de inrichting en hetgeen partijen omtrent het gebruik voor ogen stond, in overwegende mate voor een ander doel dan voor bewoning in gebruik is. De omstandigheid dat de benedenverdieping als woonruimte in gebruik is genomen wordt niet betwist, deze omstandigheid brengt mee dat op het geheel van het huurregime woonruimte van toepassing is. De gehuurde ruimte valt niet onder de omschrijving van art. 7A-1624 lid 2 BW. De rechtbank oordeelt dat de gehuurde ruimte niet als woonruimte kan worden aangemerkt in de zin van Huurprijzenwet Woonruimte.
