Onderwerp
Beperkingen stakingsrecht, art. 6 lid 4 ESH en art. 31 ESH.
Casus
VSN is aandeelhoudster van bijna alle streekbusmaatschappijen in Nederland. Zij heeft met FNV onderhandeld over een CAO, maar er is geen overeenstemming bereikt. Vervolgens kondigt FNV stakingsacties aan. Haar leden hebben zes achtereenvolgende dagen gestaakt, waardoor het streekbusvervoer ernstig is belemmerd en er veel schade is geleden. VSN vordert dat het de FNV onmiddellijk verboden wordt door te gaan met de staking. De kantonrechter honoreert dit beroep gedeeltelijk door te stellen dat er niet meer gestaakt mag worden tijdens de spitsuren.
Rechtsvraag
Kan een staking in de zin van art. 6 lid 4 ESH worden verboden of beperkt?
Hoge Raad
In beginsel moet een staking in de zin van art. 6 lid 4 ESH worden geduld als een rechtmatige uitoefening van het in deze verdragsbepaling erkende grondrecht. Toch kan het onder omstandigheden worden beperkt. Naarmate een dienst essentiëler is, zal er eerder plaats zijn voor een beperking. Dit betekent echter niet dat er nooit beperkt kan worden als een dienst niet essentieel is.
Er kan beperkt worden wanneer aan de eisen van art. 31 ESH is voldaan. De staking moet, gelet op de zorgvuldigheid die krachtens art. 6:162 BW in het maatschappelijk verkeer in acht moet worden genomen ten aanzien van de persoon en de goederen van anderen, in zodanige mate inbreuk maken op de rechten van derden of algemene belangen dat beperkingen maatschappelijk gezien dringend noodzakelijk zijn.
In casu levert de staking zoveel schade op dat is voldaan aan art. 31 lid 1 ESH: de staking mag aan beperkingen worden onderworpen door de rechter.
