Voor de toepassing van artikel 101 lid 1 VWEU is het overbodig om met de concrete gevolgen van een overeenkomst rekening te houden wanneer blijkt dat deze overeenkomst tot doel heeft de mededinging te verhinderen, te beperken of te vervalsen.
Het onderscheid tussen ‘inbreuken naar strekking’ en ‘inbreuken naar gevolg’ houdt verband met de omstandigheid dat bepaalde vormen van collusie tussen ondernemingen naar hun aard kunnen worden geacht schadelijk te zijn voor de goede werking van de normale mededinging.
Een overeenkomst die de handel tussen lidstaten ongunstig kan beïnvloeden en een mededingingsbeperkende strekking heeft, vormt naar haar aard en los van elk concreet gevolg ervan een merkbare beperking van de mededinging.
