Erfpachtverhouding - Arrest

HR 16 maart 1977 (Erfpachtverhouding)

Casus:

Het geschil gaat over de vraag of de tegenprestatie die bij de uitgifte van een stuk grond in erfpacht door een erfverpachter werd bedongen, in zijn geheel als canon beschouwd moet worden. De vraag is namelijk of de verplichtingen van de gemeente Rotterdam om de kademuur te onderhouden en ervoor te zorgen dat het water in de haven op de overeengekomen diepte zal worden gehouden, een onderdeel van het erfpachtrecht uitmaakt of een afzonderlijke obligatoire overeenkomst is. De inspecteur heeft namelijk voor een aangifte op grond van art. 11 Wet Belastingen Rechtsverkeer, ook de vergoeding die de erfpachter aan de erfverpachter betaalt voor het onderhouden van de kademuur en het onderhouden van een bepaalde diepte van het vaarwater tot de canon gerekend.

Rechtsregel:                                      

Het Hof en de Hoge Raad kiezen voor de “legistische” methode: partijen zijn volgens art. 782 OBW (art 5:85/86) vrij om hun erfpachtverhouding naar eigen goeddunken te regelen. Als is uitgemaakt, dat het op diepte houden van het vaarwater in rechtstreeks verband staat met de geschiktheid van het terrein voor het gebruik waarvoor het in erfpacht is gegeven, dan verzet zich niets tegen het incorporeren van die verplichting in het erfpachtrecht. Men mag alleen niet in strijd komen met het wezen van het erfpachtrecht.
