Casus
Het gaat in deze zaak om de toepassing van de ‘in beginsel strakke regel’ bij een verandering of vermeerdering van het door gedaagde in eerste aanleg gevoerde verweer wordt in hoger beroep (vgl. HR 20 juni 2008, NJ 2009, 21 (Willemsen/NOM) en HR 23 september 2011, NJ 2013, 6 (Pessers/Ru-Pro)).
Hoge Raad
Ook voor verweren die door de geïntimeerde worden aangevoerd tegen de vordering van de oorspronkelijke eiser, geldt dat – behoudens aanvaarde uitzonderingen – uitbreiding daarvan dient plaats te vinden in de eerste conclusie in hoger beroep.
N.B. De Hoge Raad oordeelt het afstandsbeding inhoudende dat verhuurder bij onteigening geen schadevergoeding jegens huurder is verschuldigd ex artikel 3:40 lid 2 BW niet nietig, maar vernietigbaar. Van een plicht tot ambtshalve aanvulling van rechtsgronden buiten de grenzen van de rechtsstrijd is daarom geen sprake. Omdat het een geheel nieuw verweer was dat niet in het verlengde lag van de reeds door partijen omlijnde rechtsstrijd in appel en zich hier niet een van de uitzonderingen op de ‘in beginsel strakke regel’ voordoet, heeft het hof door die uitbreiding van het verweer te aanvaarden de door de goede procesorde op dit punt gestelde grenzen miskend. Dat wordt niet anders doordat het hof zelf dit verweer aan de orde heeft gesteld, omdat voor de grondslag waarop het hof heeft te beslissen niet bepalend is wat het hof aan de orde heeft gesteld maar, ingevolge artikel 24 Rv, hetgeen de partijen aan hun vordering en verweer ten grondslag hebben gelegd en ten grondslag mochten leggen gelet op de goede procesorde in verband met het stadium waarin de procedure zich bevond.
