Casus

Het hof heeft uit eigen beweging informatie vanaf het internet opgezocht en deze informatie gebruikt in de zaak. Hierbij zijn de procespartijen niet op de hoogte gesteld van dit gebeuren en hebben de niet de gelegenheid gekregen op deze informatie te reageren.

Rechtsvraag

Mag de rechter gegevens van internet halen en deze betrekken bij zijn besluitvorming zonder de partijen daarbij op de hoogte te stellen en hen de mogelijkheid te geven om te reageren op deze verkregen informatie?

Hoge raad

Het gerechtshof heeft zijn beslissing gegrond op feiten die uit eigen beweging van de rechter via het internet verkregen zijn, zonder dat deze feiten opgenomen waren in het procesdossier.. Het is de rechter toegestaan gegevens van het internet te gebruiken, echter moet hij daar wel secuur mee omgaan. De rechter dient de partijen daar over te informeren en hen in de gelegenheid te stellen te reageren op deze verkregen informatie. De Hoge Raad vernietigt hierbij het besluit van het gerechtshof op grond van het feit dat er in strijd met het beginsel van hoor en wederhoor was gehandeld.
