Lokaliseren van een ‘omissiedelict’
In deze zaak gaat het erom welk recht van toepassing is op de vraag of de neven van een erflater onrechtmatig handelen door te weigeren een in Amsterdam gevestigde bank toestemming te verlenen gelden of goederen aan de erfgenamen af te geven, welke tot de nalatenschap behoren.
Naar Nederlands internationaal privaatrecht wordt een vordering uit onrechtmatige daad, behoudens rechtskeuze, in beginsel beheerst door het recht van het land waar de onrechtmatige daad heeft plaatsgevonden. Nu de neven weigeren om aan de bank in Amsterdam toestemming te verlenen de gelden of goederen af te geven aan de erfgenamen – er is sprake van een zgn. ‘omissiedelict’ – moet de plaats waar zodanige toestemming is vereist om tot afgifte te kunnen leiden (Amsterdam) worden aangemerkt als de plaats waar de veronderstelde onrechtmatige daad heeft plaatsgehad.
Als plaats waar de onrechtmatige daad heeft plaatsgevonden, moet in dit geval worden beschouwd de plaats waar moet worden gehandeld dan wel had moeten worden gehandeld. Mede in aanmerking genomen dat een tot een bepaalde persoon gerichte verklaring, om haar werking te hebben, deze persoon moet hebben bereikt, is in dit verband niet de woon- of verblijfplaats van de neven, maar de plaats van vestiging van de bank van belang.
