Casus
Een kade is over een lengte van 60 meter verschoven, waardoor water uit de zogeheten ‘tussenboezem’ de achterliggende woonwijk is ingestroomd. In de onderhavige procedure hebben de bewoners het Hoogheemraadschap aansprakelijk gesteld voor het deel van de schade dat de zij nog niet vergoed hadden gekregen. Zij hebben daartoe primair gesteld dat er sprake was van een gebrekkige opstal en subsidiair dat het Hoogheemraadschap is tekortgeschoten in de zorg die van een goed beheerder mag worden verwacht.

Rechtbank
De rechtbank oordeelt dat de kade inderdaad als ‘opstal’ in de zin van artikel 6:174 BW kan worden aangemerkt. Echter, op grond van de diverse rapporten en overige informatie oordeelt de rechtbank dat niet is bewezen dat de kade niet voldeed aan de eisen die men daaraan in de gegeven omstandigheden mocht stellen, gelet op de stand van de kennis en techniek in de periode voorafgaand en ten tijde van het bezwijken van de kade.
Volgens de bewoners had het Hoogheemraadschap onvoldoende adequate onderhouds-maatregelen getroffen. De rechtbank komt tot het oordeel dat de werkzaamheden die het Hoogheemraadschap in de jaren voorafgaande aan de dijkdoorbraak had verricht, blijk geven van een gerechtvaardigde prioriteitstelling. Op basis van de toenmalige kennis en stand van de techniek mocht het Hoogheemraadschap erop vertrouwen dat de kade tegen de destijds bekende mate van belasting was opgewassen en dat zij mocht volstaan met de werkzaamheden die zij toen heeft verricht. Het Hoogheemraadschap is volgens de rechtbank dan ook niet beneden de zorg van een goed beheerder gebleven. De rechtbank wijst de aansprakelijkheid af.
