De uitzending van televisieprogramma’s zowel als het doorgeven ervan valt onder het vrije verkeer van diensten van het verdrag. Artikel 49 verlangt niet alleen de afschaffing van iedere discriminatie van de in een andere lidstaat gevestigde dienstverrichter op grond van diens nationaliteit, maar tevens de opheffing van iedere beperking, ook die zonder onderscheid, waardoor een dienstverrichter uit een andere lidstaat wordt belemmerd. Milieubescherming kan een rechtvaardiging zijn van een beperking, in casu was de beperking onevenredig.
