Feiten
De verzoekster in deze zaak is de Stichting die ingevolge artikel 3 van de Wet inzake Bloedvoorziening (WiBv) verantwoordelijk is voor de bloedvoorziening in Nederland. Om de kwaliteit en veiligheid van de bloedproducten te garanderen, heeft de Stichting een beleidontwikkeld voor de keuring en selectie van donoren. Personen die als gevolg van hunseksueel gedrag een groot risico lopen op ernstige bloedoverdraagbare infectieziekten zijn uitgesloten van bloed- en plasmadonorschap. Met andere woorden, op grond van dit beleid worden mannen die seksuele contacten hebben (gehad) met ander mannen uitgesloten als bloeddonor. Is het beleid, om mannen die seksuele contacten hebben (gehad) met andere mannen uit te sluiten van het bloeddonorschap, in overeenstemming is met de gelijke behandelings-wetgeving?
Oordeel
De Commissie heeft geoordeeld dat de stichting hiermee direct onderscheid maakt, maar dat strikte toepassing van de regel naar maatstaven van redelijkheid en billijkheid tot onaanvaardbare gevolgen zou leiden, omdat de gezondheid van ontvangers van bloed door zo’n toepassing ernstig bedreigd kan worden. De Commissie beveelt de Stichting aan om, naast haar zorg voor maximale veiligheid van de bloedproducten, ook haar verantwoordelijkheid jegens personen met een homoseksuele geaardheid moet nemen door te (blijven) zoeken naar middelen om een minder stigmatiserend beleid te kunnen voeren.
