De revindicatie van gestolen zaken ex art. 2014 OBW/3:86
lid 3 BW geldt ook voor de eigenaar die door onachtzaamheid het bezit verloor.
 

Feiten

Van S. wordt een auto gestolen, in de auto bevinden zich de kentekenbewijzen deel I, II en III en de kopie deel III, hetgeen de auto aanzienlijk makkelijker verhandelbaar maakt G.,te goeder trouw, koopt de auto bij een garagebedrijf
Centraal Beheer NV, gesubrogeerd in de rechten van S., eist de auto op.
G. stelt dat door de onachtzaamheid van S. de schijn van beschikkingsbevoegdheid van de garagehouder is opgewekt, Deze was immers in het bezit van alle bijbehorende papieren.
 

Beslissing

Noch uit de tekst van de wet, noch uit de parlementaire geschiedenis van art 3:86 blijkt dat de opeising niet toekomt aan de eigenaar die zijn bezit door onachtzaamheid verliest. De goede trouw van G. doet i.c. dus niet ter zake. S. kan ex art 3:86 lid 3 de auto opeisen.

Voor de interpretatie van art. 2014 lid 2 OBW geeft de HR hier (min of weer) anticiperende werking aan bet NBW. De HR is echter tevens van mening dat de uitzondering in art. 3:86 lid 3 onder a (consumentenkoop) zich niet leent voor anticiperende werking. Dat zou immers hebben geleid tot bescherming van de derde te goeder trouw G.: aangezien hij de auto hij een garagebedrijf kocht.
