Rechtsregel
Bij de beoordeling van de soortgelijkheid van de betrokken waren of diensten – waarvoor het merk is ingeschreven en die waarvoor het teken wordt gebruikt – als bedoeld in artikel 2.20 lid 1, sub b BVIE moet rekening worden gehouden met alle relevante factoren die de verhouding tussen de waren of diensten kenmerken.
Dat zijn onder meer hun aard, bestemming en gebruik, maar ook het concurrerend dan wel complementair karakter ervan.
