De verlening van uitsluitende rechten voor het gehele grondgebied van een lidstaat moet worden aangemerkt als de toekenning van een machtspositie op een wezenlijk deel van de gemeenschappelijke markt aan de begunstigde onderneming.
Artikel 106 jo. 102 VWEU verzet zich tegen een nationale regeling die, zonder objectieve reden en zonder dat dit noodzakelijk is ter vervulling van een taak van algemeen belang, tot gevolg heeft dat een onderneming aan wie een uitsluitend recht is verleend wordt begunstigd en haar machtspositie wordt versterkt.
