Brok/Huberts (HR 09-01-1998, NJ 1998, 272)
Feiten
Huberts koopt van Brok een twee maanden oude rashond voor fl. 900,-. De hond lijdt aan heupdysplasie. Dit is grotendeels een erfelijke aandoening. Dit blijkt echter niet uit de stamboom die Brok aan Huberts getoond heeft tijdens het sluiten van de koopovereenkomst. Huberts laat de hond opereren (fl. 3000,-) en wil deze kosten vergoed krijgen van Brok. De vordering wordt gebaseerd op het non-conformiteitsvereiste van art. 7:17 jo. 6:74 BW.
Hoge Raad
Art. 7:17 BW biedt geen basis voor schadevergoeding. De vereisten van art. 6:74 BW, het artikel dat wel basis voor schadevergoeding biedt, zijn:
- tekortkoming in de nakoming van de verbintenis
- toerekenbaarheid van de tekortkoming aan de schuldenaar
Bij non- conformiteit is altijd sprake van tekortkoming, dus er is voldaan aan het eerste vereiste. Het tweede vereiste is echter niet meegenomen in de beoordeling. Daarom vernietigt de HR het arrest. De tekortkoming kan de schuldenaar worden toegerekend op grond van:
- schuld
- risico, krachtens wet, rechtshandeling of verkeersopvattingen.
