Exoneratieclausules. Uitsluiting van aansprakelijkheid voor wanprestatie en onrechtmatige daad, veroorzaakt door personeel, is geoorloofd; ook in geval van opzet en grove schuld.
Feiten
Koudijs had zijn chevrolet in reparatie gegeven bij de garage van Jansen en van den Bopsch. Door onoordeelkundig handelen van een personeelslid viel de auto van de brug. De verzekeringsmaatscappij van Koudijs wilde vergoeding van de garage. Dez beroept zich op de "bovag-clausule" die een vergaande uitsluiting van aansprakelijkheid inhield.
Beslissing
Uitsluiting van aansprakelijkheid is geoorloofd, zowel ten aanzien van de gevolgen van wanprestatie als van onrechtmatige daad veroorzaakt door personeel. Ook al is er sprake van boze opzet.
Sleutelwoord: contractsvrijheid. De clausule was onderdeel van de overeenkomst. Koudijs had zelf de keuze die overeenkomst wel of niet te sluiten.
