International Court of Justice, Application of the Convention on the prevention and punishment of the crime of genocide (Bosnia and Herzegovina vs. Serbia and Montenegro), judgement of 26 february 2007
Casus
Beweerd werd dat Servië de Bosniak (het islamitisch gedeelte van de bevolking van Bosnië-Herzegovina had geprobeerd uit te roeien.
The Court of Justice
Zij bevestigde dat er inderdaad sprake was van genocide in Srebrenica, zij vallen dus kortom in de Convention. Er werd echter wel bepaald dat Servië niet direct verantwoordelijk was voor deze genocide, noch dat zij er medeverantwoordelijk voor was. Werd had Servië gehandeld in strijd met het genocide verdrag, door niet te voorkomen dat de genocide plaats vond en vervolgens door niet samen te werken met het ICTY. Bij dit laatste had het ICTY namelijk tot doel om degenen die deze genocide gepleegd hadden, te straffen.
