Casus
Een aantal bewoners te Amsterdam vroegen de burgemeester om een blowverbod af te kondigen voor een speeltuin. In een APV in Amsterdam is de bevoegdheid hiervoor opgenomen. De burgemeester wees het verzoek, op basis van de zwaarte van het middel.
ABRS
Een Gemeentelijk blowverbod is in strijd met de Opiumwet. Het aanwezig hebben van drugs is bij wet verboden (Opiumwet), dit omvat ook softdrugs. Er bestaat dus geen behoefte aan een regeling op Gemeentelijk niveau die dit verbod nog eens over doet.
