Blomaard/Gemeente Utrecht (HR 30-10-2009, LJN BJ6020; NJ 2010/52)
Casus
Blomaard was als ambtenaar werkzaam bij de gemeente. Tijdens een werkpauze, terwijl hij onderuit gezakt op een stoel zat, is een collega achter hem gaan staan en heeft hem in een greep genomen. Blomaard heeft zowel zijn collega als de gemeente aansprakelijk gesteld voor de schade die hij als gevolg van de greep heeft geleden.
Rechtbank
De rechtbank heeft geoordeeld dat de gemeente op grond van artikel 6:170 BW aansprakelijk is voor de fout van de collega. Het hof heeft geoordeeld dat de gemeente niet op de voet van artikel 6:170 BW aansprakelijk is en het vonnis vernietigd.
Hoge Raad
Volgens de Hoge Raad moet bij de beantwoording van de vraag of de kans op de fout van de ondergeschikte door de opdracht tot het verrichten van zijn taak is vergroot, aan de hand van alle ter zake dienende omstandigheden worden onderzocht of tussen de fout van de betrokken werknemer en diens werk in dienstbetrekking een zodanig verband bestaat dat zijn werkgever voor de daardoor veroorzaakte schade aansprakelijk is.
Het hof heeft zich echter beperkt tot een beantwoording van de vraag of de kans op de fout is vergroot door een opdracht aan Blomaard tot het verrichten van een ‘bepaalde taak’. Het hof heeft aldus ten onrechte nagelaten te beoordelen of daarbij de andere door Blomaard gestelde omstandigheden meebrachten dat sprake is van een door het verrichten van zijn taak verhoogde kans op de door hem als werknemer van de gemeente gemaakte fout.
