Beschikking 84/405 (Zinc Producer Group)
De Commissie acht in deze beschikking het beschikbare bewijsmateriaal onvoldoende om het parallelle gedrag van de betrokken ondernemingen als onderling afgestemd feitelijk gedag in de zin van artikel 101 VWEU aan te merken. De Commissie concludeert dat het parallelle marktgedrag het resultaat was van een vorm van oligopolide interdependentie, te weten: ‘barometrisch prijsleiderschap’.
