Casus
In casu buigt het Internationaal Hof zich over de gewapende activiteiten in de Democratische Republiek van Congo uitgevoerd door Oeganda, in de periode van augustus 1998 en juni 2003.
Oeganda zou hierbij het verbod tegen agressief gebruik van geweld en de internationale mensenrechten hebben geschonden.
Rechtsvraag
Heeft Uganda onrechtmatig gebruik van geweld gemaakt en is er sprake geweest van schending van de territoriale soevereiniteit?
Hof
Oeganda beroept zich op zelfbescherming op basis van artikel 51 VN Verdrag maar dit wordt afgewezen door het Hof. Het Hof stelt dat er geen bewijs zou bestaan dat Congo Oeganda zou hebben aangevallen en dat hierdoor zelfbescherming noodzakelijk zou zijn geweest.
Volgens het Hof bestaat er geen bewijs dat Uganda een speciale beweging voor de bevrijding van Congo (MLC) heeft opgericht. Wel heeft Oeganda training en militaire steun aan deze beweging verschaft. Voorts bevestigt het Hof dat het “beginsel van geen interventie” een verbod behelst voor staten om (direct of indirect) te interveniëren met of zonder geweld.
Verder stelt het Hof dat de soevereiniteit en de territoriale integriteit van Congo door Oeganda is geschonden. De acties van Oeganda hebben een inbreuk op de interne aangelegenheden van Congo ingehouden. Bovendien was de Oegandese onrechtmatige legerinterventie zo omvangrijk dat het Hof stelt dat er sprake is geweest van een ernstige schending van het geweldsverbod.
Het Internationaal Hof stelt vast dat de gewapende activiteiten van Oeganda in de Republiek van Congo het verbod van gebruik van geweld en ook de internationale mensenrechten hebben geschonden.
