Anti-kraakbepaling Arnhem

Casus

In Arnhem wordt door twee personen een huis gekraakt. Dit is volgens art. 84 van de Arnhemse APV strafbaar. De rechtbank Arnhem veroordeelt de krakers dan ook tot een boete van fl.25,-. Een kraker gaat in cassatie en stelt het volgende:

de anti-kraakbepaling van art. 84 APV is in strijd met art. 168 Gemeentewet, omdat deze bepaling niet in het belang is de openbare orde, zedelijkheid of gezondheid en evenmin de huishouding van de gemeente betreft;

de bepaling van art. 84 APV is in strijd met de hogere regeling van art. 138 Wetboek van Strafrecht (Sr), waarin deze materie uitputtend is geregeld, zodat voor de gemeentelijke wetgever geen ruimte op dit terrein meer bestaat.

Hoge Raad

De Hoge Raad verwerpt het beroep met de volgende redenering: "...noch uit tekst of strekking van art. 138 Sr noch uit de wetsgeschiedenis blijkt, dat de rijkswetgever aan de gemeentelijke wetgever de bevoegdheid zou hebben willen ontnemen om met betrekking tot niet in gebruik zijnde gebouwen straf te bedreigen als bedoeld in art. 84 APV"

Daarnaast is de anti-kraakbepaling van art. 84 APV niet in strijd met art. 168 Gemeentewet, omdat aard en omvang van de gedragingen die art. 84 noemt zodanig kunnen zijn, dat zij de openbare orde kunnen treffen.
