Agroferm - Arrest

Agroferm (HvJ EU 20-06-2013, AB 2014/270)

Hier betrof het het Geharmoniseerde Systeem inzake de codering en omschrijving van goederen. Dit systeem bepaalt hoe een bepaald goed moet worden geclassificeerd, wat van belang is in douanezaken. Het ging in casu om de betekenis van de term ‘onzuiverheden’, stoffen die door vervaardiging in een product zijn gekomen. De Deense onderneming Agroferm heeft een stof geproduceerd die gebaseerd is op suiker. Er zijn teruggaven ontvangen voor de hoeveelheid geproduceerde stof. Er werd na onderzoek echter besloten om het product in een ander hoofdstuk van de GS in te delen. Agroferm moest als gevolg hiervan 86.6 miljoen euro terugbetalen aangezien er door de herkwalificatie van het product geen aanspraak meer bestond op teruggaaf. Bij toekenning van de teruggaven handelde Agroferm niet te goeder trouw. De zaak werd doorverwezen naar het HvJ EU voor een prejudiciële beslissing. De eerste vraag betrof de vraag onder welke categorie de betreffende stof viel. Hiervoor moet naar de gemeenschappelijke kenmerken van goederen worden gekeken. Als een product onzuiverheden bevat die na het productieproces zijn overgebleven, met als gevolg dat het product voor bijzondere toepassingen kan worden gebruikt, dan is het product niet langer een geïsoleerd product. Het product was bedoeld om als toevoeging bij diervoeder gebruikt te worden. Een producent kan pas teruggaaf krijgen indien duidelijk is onder welke categorie zijn product valt. In casu leidt herkwalificatie ertoe dat de teruggaaf nooit had mogen worden verleend. Het vertrouwensbeginsel staat niet aan terugvordering van het bedrag in de weg.
