Advisory Opinion of 28 May 1948 - Conditions of Admission of a State to Membership in the United Nations
Als het om toegang als lid gaat, zijn het de voorwaarden die art. 4 van de Charter stelt die uitputtende zijn. Het artikel wordt geanaliseerd. Zij zijn:
een staat
peace loving
moet de verplichtingen van de Charter accepteren
moet in staat zijn deze verplichtingen uit te oefenen
moet hiertoe bereid zijn
Al deze voorwaarden zijn onderworpen aan het oordeel van de Verenigde Naties. Deze voorwaarden zijn uitputtend en het is dan ook niet toegestaan om andere voorwaarden hierbij op te tellen, door het bijvoorbeeld af te laten hangen van het (politieke) oordeel van andere staten.
