Mobiel toezicht binnengrenzen
Onder verwijzing naar eerder Afdelingsjurisprudentie overweegt de Afdeling dat de rechtbank terecht heeft overwogen dat, daargelaten de vraag of artikel 4.17a Vb voldoet aan de in ‘Melki en Abdeli’ (HvJ 22 juni 2010, C-118/10 en C-189/10) verlangde waarborgen, de staandehouding onrechtmatig is, reeds nu het proces-verbaal niet inzichtelijk maakt op grond waarvan de vreemdeling is staandegehouden en hoe de staandehouding is geschied. Zij heeft daarbij in aanmerking mogen nemen dat het proces-verbaal dermate onvolledig is dat de waarborgen die bij de controle gelden aan de hand van het proces-verbaal niet (afdoende) getoetst kunnen worden en dat de enkele vermelding in het proces-verbaal, dat de controle is uitgevoerd conform artikel 4.17a Vb, daartoe onvoldoende is.
De rechtbank heeft het aanbod van de minister om alsnog een overzicht dan wel aanvullend proces-verbaal van de betreffende controle op te vragen en te overleggen, mede gelet op de mate van onvolledigheid en onduidelijkheid, mogen afwijzen.
