Artikel 57 lid 3 Fw heeft, zoals de Hoge Raad heeft geoordeeld in Aerts q.q./ABN AMRO, geen verdere strekking dan te voorkomen dat een schuldeiser die in rang boven een pand- of hypotheekhouder gaat, in geval van faillissement van de schuldenaar niettemin deze hoge rang niet zou kunnen geldend maken, omdat hij zijn rechten slechts kan doen gelden in het faillissement, terwijl de pand- of hypotheekhouder ingevolge artikel 57 lid 1 Fw zijn rechten juist uitoefent alsof er geen faillissement was en de aldus verkregen opbrengst derhalve buiten het faillissement blijft. Een boedelschuldeiser heeft, in tegenstelling tot de hiervoor bedoelde bevoorrechte schuldeiser, wel de mogelijkheid zijn rechten buiten het faillissement geldend te maken. In overeenstemming met de strekking van artikel 57 lid 3 Fw moet daarom worden aanvaard dat deze bepaling niet van toepassing is op boedelschuldeisers.
