Casus
De belastinginspectie legt aan een gemeente een naheffingsaanslag op voor de omzetbelasting, omdat die gemeente bepaalde aftrekposten opvoerde die in strijd waren met de wet (uitspraak Tariefcommissie), maar in overeenstemming met een Resolutie van de staatssecretaris.

De taak van de belastingrechter bij zijn beoordeling van de rechtmatigheid is niet beperkt tot de vraag of de inspecteur binnen de door de wet gestelde grenzen is gebleven, maar ook of de inspecteur anderszins in strijd met het recht heeft gehandeld doordat hij niet in overeenstemming met de Abbb, (die in acht moet worden genomen) heeft gehandeld.
Onder omstandigheden kan strikte toepassing van de wet, waaruit de belastingschuld rechtstreeks voortvloeit, in die mate in strijd komen met een of meer Abbb’s dat toepassing van de wet achterwege dient te blijven.
De vraag onder welke omstandigheden zich dit voordoet, moet van geval tot geval worden bekeken door afweging van het beginsel dat de wet moet worden toegepast tegen één of meer in aanmerking komende Abbb’s.
Aan het beginsel dat de administratie gerechtvaardigde verwachtingen honoreert, zal doorslaggevende betekenis moeten worden toegekend als een belastingplichtige zodanig vertrouwen heeft mogen ontlenen aan uitlatingen (afkomstig van voor de belastingdienst verantwoordelijke bewindslieden) welke uitlatingen (al werden zij noch in het Staatsblad, noch in de Staatscourant opgenomen) met medewerking of goedvinden van de belastingdienst zijn gepubliceerd en aldus ter kennis van het publiek zijn gekomen.
