AB 2015/283, Hof ’s-Hertogenbosch 7 april 2015 (Stichting de Maasveren)
Stichting de Maasveren exploiteert vijf veerdiensten tussen Gelderland en Noord-Brabant. De provinciale weg die op de veerdienst aansluit is deels in de handen van de gemeente en deels in de handen van de provincie Noord-Brabant. Van januari tot en met april 2008 waren er reconstructiewerkzaamheden aan de weg in beide zowel het gemeentelijke als het provinciale deel. De veerpont was hierdoor verminderd bereikbaar, terwijl De Maasveren volledig afhankelijk is van de bereikbaarheid van de weg. Op basis van een advies van de Stichting Adviesbureau Onroerende Zaken (SAOZ) heeft Stichting De Maasveren een schadevergoeding toegekend gekregen wegens gederfde inkomsten. De Maasveren verzoekt de gemeente om een bedrag aan schadevergoeding. Dit verzoek wordt afgewezen. Er is volgens het Hof causaal verband aanwezig tussen de geleden schade en de werkzaamheden aan de weg. Volgens het Hof waren de werkzaamheden echter te verwachten, deze behoren tot het normale bedrijfsrisico van De Maasveren. De toegang is tevens niet geheel belemmerd zoals de Stichting stelt, want er was een omleiding aanwezig en de werkzaamheden duurden slechts drie maanden. Bovendien konden gebruikers van de veerpont uitwijken naar andere veerdiensten van de stichting, die zelfs een omzetstijging kenden. De Maasveren heeft volgens het Hof geen onevenredige schade geleden. Het niet vergoeden van de schade door de gemeente is niet in strijd met het gelijkheidsbeginsel.
