Casus
Een bromfietser heeft een hartafwijking. Hij raakt vervolgens betrokken bij een verkeersongeval doordat hij aangereden wordt door een tractor, maar hij lijdt geen noemenswaardig letsel. Een paar uren na de aanrijding, overlijdt de man echter aan een hartstilstand door de heftige schrik. Dit is geen voorzienbaar gevolg van het foutief handelen van de tractorbestuurder die het ongeluk veroorzaakt had. De verzekeringsmaatschappij die een schadevergoeding aan de nabestaanden de bromfietser heeft uitgekeerd, wenst deze vergoeding op de tractorbestuurder te verhalen.
Rechtsvraag
Kan de verzekeringsmaatschappij het uitgekeerde geld op de tractorbestuurder verhalen?
Hoge Raad
Een ongeval met dodelijke afloop komt herhaaldelijk voor. Hieruit vloeit voort, dat de dader, die zo'n verkeersfout maakt, in beginsel aansprakelijk is voor het dodelijk gevolg, ook al is de wijze waarop in een bepaald geval de dood is ingetreden iets dat zelden voorkomt of buiten de lijn van normale verwachtingen ligt. Dit is slechts anders (afgezien van eigen schuld slachtoffer) als de dood is ingetreden door buiten het slachtoffer gelegen omstandigheden tussen aanrijding en overlijden, die van zodanige aard zijn, dat het overlijden redelijkerwijs niet meer als een gevolg van de aanrijding aan de dader kan worden toegerekend. In casu is hiervan geen sprake. Wel kan de hogere sterftekans van Van Baar meespelen in de hoogte van het bedrag der schadevergoeding.
