Casus

Verdachte is bij de politierechter veroordeeld voor inbraak, diefstal, poging tot inbraak en het bezitten van 0,43 gram hashish. Hij kreeg zes maanden gevangenisstraf, waarvan drie maanden voorwaardelijk met een proeftijd van twee jaren. In hoger beroep werd de verdachte van de laatste twee feiten vrijgesproken. In plaats van de straf te verlichten, legde het Hof juist een zwaardere straf op: zes maanden onvoorwaardelijke gevangenisstraf. Het Hof besloot hiertoe omdat tegen de verdachte in de tussentijd opnieuw een aantal processen verbaal van soortgelijke delicten was opgemaakt. Hiertegen ging de verdachte in cassatie.

Mag in hoger beroep een zwaardere straf opgelegd worden, omdat iemand in de tussentijd opnieuw verdacht wordt van soortgelijke delicten?

Hoge Raad

De Hoge Raad oordeelt dat het feit dat tegen iemand opnieuw processen verbaal zijn opgemaakt, niet mag leiden tot zwaardere bestraffing van de delicten in de voorafgaande periode. Zulks zou neerkomen op een dubbele bestraffing. Daarnaast drukt de Hoge Raad men op het hart dat uit het enkele feit dat iemand verdacht is, nog niet volgt dat de verdachte die delicten ook begaan heeft.

When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. Follow authors or (study) organizations: by following individual users, authors and your study organizations you are likely to discover more relevant study materials.
Search tool: quick & dirty - not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject. The search tool is available at the bottom of most pages or on the Search & Find page
Tags & Taxonomy: gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution.
