Stichting Belangenbehartiging Erfpachters/Gem. ’s-Gravenhage - Arrest
HR 26 maart 1999 (Stichting Belangenbehartiging Erfpachters/Gem. ’s-Gravenhage)
Casus:
De Gemeente ’s Gravenhage heeft grond in tijdelijke erfpacht uitgegeven, meestal voor 75 jaar. Deze periode is inmiddels verstreken of zal binnenkort verstrijken. In 1985 wordt besloten tot een nieuw systeem: onroerende zaken worden alleen nog maar uitgegeven in eeuwigdurende erfpacht tegen hetzij een afkoopsom ter hoogte van de overeengekomen prijs, hetzij tegen een vaste jaarlijkse canon afgeleid van de marktwaarde van de onroerende zaak ten tijde van de uitgifte in eeuwigdurende erfpacht. Dit systeem zal ook gelden voor heruitgifte aan zittende erfpachters na het verstrijken van de termijn waarvoor de tijdelijke erfpacht gold. Deze zittende erfpachters hebben zich verenigd in een stichting. De stichting vordert een verklaring voor recht dat de gemeente in strijd met de zorgvuldigheid heeft gehandeld op grond van haar contractuele relatie met de erfpachters, doordat volgens de nieuwe methode de vergoeding een veelvoud van de oude canon wordt.
Rechtsregel:
Volgens het Hof is er geen sprake van een contractuele relatie: het aanbod tot vestiging van een nieuw recht vloeit voort uit het reeds bestaande erfpachtsrecht. Tussen de Gemeente en de zittende erfpachters bestaat dus geen contractuele band, maar toch is na de expiratiedatum van de tijdelijke erfpacht een door de redelijkheid en billijkheid beheerste rechtsverhouding blijven bestaan. Volgens het Hof heeft de gemeente niet onredelijk gehandeld. Volgens de Hoge Raad heeft het hof niet blijk gegeven van een onjuiste rechtsopvatting.

- Starting Pages: for some fields of study and some university curricula editors have created (start) magazines where customised selections of summaries are put together to smoothen navigation. When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. Below you will find some start magazines per field of study
- Follow authors or (study) organizations: by following individual users, authors and your study organizations you are likely to discover more relevant study materials.
- Search tool: quick & dirty - not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject. The search tool is available at the bottom of most pages or on the Search & Find page
- Tags & Taxonomy: gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution. Note: not all content is tagged thoroughly, so when this approach doesn't give the results you were looking for, please check the search tool as back up
