Causaliteit.
Rechtsvraag
Bestaat er aan de hand van het criterium van redelijke toerekening een causaal verband tussen het door de verdachte uitgeoefende geweld en het letsel en kan dit als gevolg aan de verdachte worden toegerekend?
Casus
De verdachte heeft met een ander in een voor het publiek toegankelijke ruimte (een café) openlijk in vereniging geweld gepleegd tegen R.T. Het geweld bestond uit het slaan en stompen in/tegen het gezicht en schoppen tegen het lichaam van die R.T. Bij het slachtoffer is in ieder geval zwaar lichamelijk letsel ontstaan.
Rechtsgang
Het Hof vernietigt het vonnis van de rechtbank en de verdachte wordt vrijgesproken van het hem onder punt 1 van de tenlastelegging tenlastegelegde. Het aan een bewezenverklaring van dat causale verband staat in de weg dat niet geheel kan worden uitgesloten dat latere handelingen van derden mede hebben geleid tot dat lichamelijke letsel. De Advocaat-Generaal stelt zich op het standpunt dat de causaliteit tussen de gedraging en het gevolg naar vaste rechtspraak dient te worden bepaald aan de hand van de maatstaf van de redelijke toerekening. Indien de gedraging naar haar aard geschikt was om het uiteindelijk resultaat teweeg te brengen of het risico daarop in relevante mate heeft verhoogd. De Hoge Raad is het eens met de A-G. Het oordeel van het Hof geeft blijk van miskenning van de hier aan te leggen maatstaf. Dus de bestreden uitspraak van het Hof wordt vernietigd.
Conclusie
Als er in tussen de handeling en het gevolg nog gebeurtenissen plaatsvinden, betekent dit dan automatisch dat de causaliteit verdwijnt tussen de handeling en het gevolg? De Hoge Raad oordeelt dat tussenliggende gebeurtenissen niet per definitie invloed hebben op de causale keten.

When you have found a magazine of your likings, add that page to your favorites so you can easily go to that starting point directly from your profile during future visits. - Follow authors or (study) organizations: by following individual users, authors and your study organizations you are likely to discover more relevant study materials.
- Search tool: quick & dirty - not very elegant but the fastest way to find a specific summary of a book or study assistance with a specific course or subject. The search tool is available at the bottom of most pages or on the Search & Find page
- Tags & Taxonomy: gives you insight in the amount of summaries that are tagged by authors on specific subjects. This type of navigation can help find summaries that you could have missed when just using the search tools. Tags are organised per field of study and per study institution.
