Wat zijn de veranderingen in de hoorcolleges?
- Het onderwerp van het hoorcollege week 3 is dit jaar verplaats naar het hoorcollege van week 4; "aard bevoegdheid"
- Toegevoegd het verschil in expliciet of impliciet beoordelingsvrijheid. Een voorbeeld van expliciete beoordelingsvrijheid is wanneer er in een artikel van de APV Groningen letterlijk staat: "De burgemester kan NAAR ZIJN OORDEEL..". Een voorbeeld van impliciete beoordelingsvrijheid is indien bijvoorbeeld de term "openbare orde wordt gebruikt".
Wat is belangrijk voor het tentamen?
- Voor het tentamen is het belangrijk onderscheid te kunnen maken tussen de termen "beoordelingsruimte", "beoordelingsvrijheid" en "beleidsvrijheid"
- Voor het tentamen is het belangrijk om voor de verschillende termen te weten hoe de rechter toets; marginaal of volledig? De rol van de bestuursrechter is bij beoordelingsruimte actief. Er wordt vol getoetst. De rechter interpreteert de term dan ook en besluit of hij het eens is met het bestuursorgaan. Bij beoordelingsvrijheid is er een terughoudende toets. De rechter kijkt alleen of het orgaan zich in redelijkheid tot de beslissing had kunnen komen. Bij beleidsvrijheid toets de rechter marginaal, dus terughoudend.
