Casus
In dit arrest staat centraal de dringendheid van de noodzaak tot eigen gebruik. In deze zaak gaat het om de huur van woonruimte. Een professionele belegger in onroerend goed is de verhuurder. Zijn plan was om twee woningen samen te voegen en te renoveren, namelijk de onderhavige woning en de buurwoning. Als dit klaar was zou het geheel als een luxe woning worden geëxploiteerd.
Hoge Raad
Naar het oordeel van de Hoge Raad levert dit plan, dat voornamelijk is gebaseerd op financiële motieven, geen grond op voor het aannemen van dringend eigen gebruik, ook niet als de exploitatie van het verhuurde in ongewijzigde staat onrendabel is.
