Voor de ontvankelijkheid van degene die zich op artikel 230 EG verdrag beroept, is het van belang dat hij rechtsreeks en individueel geraakt is. Nu artikel 230 en 232 EG verdrag in dezelfde rechtsgang voorzien, is het voor de ontvankelijkheidsvraag van artikel 232 eveneens van belang, dat de klager rechtstreeks en individueel geraakt is.
