Hoge Raad
De Hoge Raad heeft nadrukkelijk overwogen dat de duurzaamheid van de gemeenschappelijke huishouding wordt bepaald door objectieve factoren, zoals de duur die de gemeenschappelijke huishouding reeds kent, en subjectieve factoren, zoals de bedoeling van de betrokkenen. Bij het beoordelen van de duurzaamheid van de gemeenschappelijke huishouding staat het de rechter vrij te onderzoeken hoe die bedoeling van partijen zich in de verschillende fasen van de samenwoning heeft ontwikkeld. De enkele omstandigheid dat een gemeenschappelijke huishouding van twee personen als gevolg van de leeftijd of gezondheidstoestand van een van hen naar verwachting niet langdurig zal zijn, staat er niet aan in de weg dat geoordeeld wordt dat de huishouding een duurzaam karakter heeft in de zin van art. 267 aldus de Hoge Raad.
