De directeur van het huis van bewaring De Schans, weigert om aan de vereniging van gedetineerden, vergaderruimte beschikbaar te stellen.
Rechtsvraag
Valt het beschikbaar stellen van vergaderruimte aan gedetineerden, onder het recht van vereniging en vergadering?
Hoge Raad
Door aan de gedetineerden geen vergaderruimte beschikbaar te stellen, heeft de directeur het recht van vereniging en vergadering ten aanzien van de gedetineerden, beperkt. Volgens de Hoge Raad is die beperking mogelijk, als deze beperking ofwel berust op een wet in materiële zin, ofwel op een beschikking van een daartoe rechtens bevoegde autoriteit. De rechter toetst of de beslissing van de directeur redelijk was, in casu was dat niet het geval.
De Hoge Raad is van oordeel, dat de weigering van de directeur om een vergaderruimte beschikbaar te stellen, een ongeoorloofde beperking van het recht van vereniging en vergadering is geweest.
